This Privacy Policy describes how Man Down (“Man Down,” “we,” “us”), operated from Montréal, Québec, Canada, collects, uses, retains, and discloses personal information in connection with the Man Down application and website (the “Service”). The person responsible for the protection of personal information may be contacted at hello@trymandown.com. By using the Service, you acknowledge the practices described in this Policy.
We collect: (a) account information, being your email address and, where you authenticate through Google, your name and profile image; (b) the content of your conversations within the Service, which is retained to provide conversational continuity; (c) optional session inputs, such as mood ratings; (d) limited technical data, being your IP address, processed solely for rate limiting and abuse prevention; (e) limited, content-free service metadata, such as session timing and message length, used internally to evaluate whether the Service is functioning as intended; and (f) for waitlist registrants, an email address used solely to send a launch notification. We collect no other categories of personal information, and we operate no advertising or third-party analytics trackers of any kind.
The Service uses automated processing of your conversation content to generate internal personalization records that tailor how the Service responds to you. These records are derived exclusively from your own content, are not disclosed to any third party, are not used to make any decision producing legal or similarly significant effects concerning you, and are permanently deleted upon deletion of your data. They form part of your personal information and are available to you upon request in accordance with Section 7.
Personal information is stored on infrastructure located in Canada. To operate the Service, certain processing is performed on our behalf by service providers, comprising: a cloud database and authentication provider (Canada); an AI language-processing provider (United States); a voice-synthesis provider (United States), engaged only where you use voice features; and a transactional email provider. Each provider is contractually limited to processing personal information solely to provide its services to us, and no provider is permitted to use your conversation content for its own purposes, including the training of artificial-intelligence models. Where personal information is communicated outside Québec, we assess the protection it will receive in accordance with applicable law before engaging the provider. A current list of the categories of providers is available upon written request.
We process personal information to provide and secure the Service, to maintain conversational continuity, to evaluate Service performance, and to comply with legal obligations. For users in the European Economic Area or the United Kingdom, our legal bases are the performance of our contract with you (Art. 6(1)(b) GDPR) and, in respect of any special-category data inferable from your conversation content, your explicit consent (Art. 9(2)(a) GDPR), which you may withdraw at any time.
Conversation content and personalization records are retained for the duration of your account. Upon deletion, data is removed from production systems immediately and from encrypted backups within 35 days through routine backup rotation. Waitlist email addresses are retained no longer than one year following the launch notification. Service metadata is retained thereafter only in aggregate, non-identifying form.
Subject to applicable law, you have the right to access the personal information we hold about you, to have it rectified, to have it deleted, to receive it in a structured, commonly used technological format, and to withdraw consent to its processing. Deletion is available directly within the Service (Settings → Delete My Data) and takes effect without further steps. All other requests may be directed to hello@trymandown.com and will be answered within thirty (30) days. Residents of Québec may lodge a complaint with the Commission d’accès à l’information du Québec; residents of the European Economic Area may lodge a complaint with their supervisory authority.
We employ technical and organizational safeguards proportionate to the sensitivity of the information we hold, including access controls that restrict conversation data to the account that created it, server-side isolation of all credentials, and data minimization. In the event of a confidentiality incident presenting a risk of serious injury, we will notify affected persons and the authorities required by law without undue delay and will maintain the incident register required by applicable legislation.
The Service is available only to persons aged 18 or older. We do not knowingly collect personal information from minors; any account determined to belong to a minor will be closed and its data deleted.
Material amendments to this Policy will be communicated to account holders by email before taking effect. The effective date above identifies the version in force.

These Terms of Service (the “Terms”) constitute a binding agreement between you and Man Down, operated from Montréal, Québec, Canada, governing your use of the Service. You accept these Terms by creating an account or using the Service. If you do not accept them, you must not use the Service.
The Service provides conversational interaction with artificial-intelligence companions identified as “Jordan” and “Luna.” The Service is not a healthcare service. Jordan and Luna are not natural persons and are not therapists, psychologists, physicians, counselors, or crisis responders; no output of the Service constitutes medical, psychological, legal, or other professional advice, and use of the Service does not create a treatment or professional relationship of any kind. The Mental Health Disclaimer below forms an integral part of these Terms.
The Service is not designed or equipped to respond to emergencies. If you are in danger or experiencing thoughts of suicide or self-harm, contact emergency services or a crisis line before using the Service: in Canada, 1-833-456-4566; in the United States, call or text 988; elsewhere, findahelpline.com.
You must be at least 18 years of age to use the Service. By using the Service you represent that you meet this requirement. Accounts determined to belong to minors will be terminated and their data deleted.
You are responsible for activity occurring under your account. During early access, access codes are personal and non-transferable: each code is issued to a single individual, is technically bound to the account or accounts of the person who first uses it, and may not be shared, published, or redistributed. We may suspend codes that show use inconsistent with issuance to a single individual.
You shall not use the Service to plan or facilitate harm to any person; to harass or threaten; to probe, disrupt, or circumvent the security or operation of the Service; to attempt to extract the Service’s underlying instructions or configuration; to reverse-engineer, resell, or commercially exploit the Service; or in violation of any applicable law.
As between you and Man Down, you retain all rights in the content you submit. You grant Man Down a limited, non-exclusive licence to host, process, and store that content solely as necessary to operate the Service for you, including the automated processing described in the Privacy Policy. Your conversation content is not used to train artificial-intelligence models. The Service, including its software, design, branding, and the Jordan and Luna characters, is and remains the exclusive property of Man Down; no rights are granted except as expressly stated.
The Service is currently provided without charge. Any future fees will be disclosed before you incur them.
The Service is an artificial-intelligence system and may produce inaccurate, incomplete, or unsuitable output, and its availability and data continuity are not guaranteed. To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties or conditions of any kind, whether express, implied, or statutory. This section does not exclude warranties that cannot be excluded under the laws applicable to you, including the Civil Code of Québec and the Québec Consumer Protection Act.
To the maximum extent permitted by applicable law, the aggregate liability of Man Down arising out of or relating to the Service shall not exceed the amounts you paid to Man Down in the twelve (12) months preceding the event giving rise to the claim, and Man Down shall not be liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional or gross fault, nor does anything in these Terms limit rights you hold under mandatory consumer-protection legislation.
You may terminate at any time by deleting your data within the Service. We may suspend or terminate accounts for material breach of these Terms. If the Service is discontinued, we will provide reasonable advance notice and a period during which you may obtain or delete your data.
We may amend these Terms. Material amendments will be communicated to account holders before taking effect; continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. Subject to any non-waivable right you hold as a consumer to proceed in the courts of your place of residence, the courts of the judicial district of Montréal have jurisdiction over disputes arising from these Terms or the Service.

They are not licensed therapists, psychologists, psychiatrists, physicians, or mental-health professionals, and the Service is not a crisis service. Interaction with the Service does not constitute therapy, counseling, diagnosis, or treatment, and is not a substitute for professional mental-health or medical care. Output of the Service may be inaccurate; consult a qualified professional before acting on anything that concerns your health.
